1099 late filing penalty calculator

Enter how many forms are late and when you filed them. The calculator applies the IRS amounts to the IRS copy and the recipient copy separately, because each one carries its own penalty.

How the IRS charges 1099 penalties

There are two penalties, and a late form usually triggers both:

Each is charged per form, and the amount depends on how late the correct form is. A form with a wrong TIN or a wrong amount counts as incorrect, which is penalized like a late one.

Ways to pay less or nothing

Avoid the penalty in the first place

In the IRIS era, many 1099 penalties come from rejected uploads that nobody fixed in time. Check your file with the free IRIS CSV checker before the deadline, and use the pre-upload checklist. If a submission is rejected, file a replacement within 60 days.

Frequently asked questions

How much is the penalty for a late 1099-NEC in 2027?
$60 per form if it is filed up to 30 days late, $130 through August 1, and $340 after that or if never filed. The same amounts apply again for late recipient copies.
Is the penalty per form or per filing?
Per form. Ten 1099-NECs filed 40 days late cost $130 each for the IRS copies, $1,300 in total, plus the same again if the recipient copies were also late.
Does the penalty apply if nobody owes tax?
Yes. Information return penalties apply whether or not anyone owes tax.
Can I get the penalty removed?
Possibly. The IRS can waive it for reasonable cause, such as a disaster or serious illness. Answer Notice 972CG or the penalty notice with a written explanation.
Does the IRS charge interest on these penalties?
Yes. Interest runs until the penalty is paid in full. The calculator does not include it.
